By using the Looksee Inspections website, you agree to the following Terms of Use. Your use of our web site indicates your acceptance of these terms and conditions. Your placement of a booking or request for services also indicates your acceptance of these terms and conditions.

Bookings placed via our website or electronic means which may include but not be limited to text messages and e-mails are carried out in good faith, and are considered a promise to buy. All information you supply during the booking enquiry or booking process is considered true and correct.

While every effort has been made to ensure that the information published on the site is accurate, Looksee Inspections shall not be liable for any loss or damage (including any indirect or consequential loss) arising in any way from inaccuracies published on the website or marketing materials. Looksee Inspections makes no warranty of any kind regarding quality, accuracy or completeness of any content on the website, which may contain inaccuracies or typographical errors, or the use of the website or any hyperlinked website and to the full extent permitted by law all representations, conditions and warranties are excluded.

No Third Party Endorsement

The website provides links and pointers to other internet websites which are controlled and maintained by third parties, industry and or government departments. These links are provided as a convenience, and do not constitute an endorsement by Looksee Inspections of the websites linked or referred to.

No endorsement of any third-party products, services or Web sites is intended by any content or links on this Web site.

Looksee Inspections respects and values privacy and acknowledges that it has an obligation at law to protect the personal information of others, including customers, employees, contractors and other individuals.

This policy applies to all of Looksee Inspections owners, employees, contractors and consultants.

Policy Statement

The following policy explains how and when personal information is collected, used, stored and disclosed by Looksee Inspections in accordance with The Privacy Act 1988 and under the Australian Privacy Principles (APP).

Personal Information

Personal information is defined as information or an opinion about a living person who is identified or reasonably identifiable, whether or not true and whether or not recorded in material form.

How we collect your information (APP 1)

The main purposes for which we collect personal information are:

  • for administration and management purposes in relation to your potential booking and engagement of services for inspections and construction projects;
  • to reply to contact made by customers or referrals given by Realtors;
    for marketing, media and public relation purposes.
  • We collect personal information directly from each individual or from a representative of the customer such as Real Estate Agents.
  • We only collect personal information where you have consented, or you would reasonably expect us to collect personal information in that way.

Anonymity and pseudonymity (APP 2)

Looksee does not allow customers to communicate and transact with it anonymously due to the sensitive nature of building and pest inspections. Customers prior to the engagement of services may communicate anonymously.

Information collected (APP 3)

The type of information collected for interaction, administrative or engagement of services would typically include your name, contact details, email, and information about your property or the property you wish to purchase.  Where relevant, we many ask for other information such as bank account details, other financial information for the purposes of commerce.

For contact and marketing purposes, information retained would be in accordance with the requirements of the account or electronic app.  This would likely include name and email.

Unsolicited personal information (APP 4)

If Looksee Inspections receives personal information about you from a source other than you, or it is information provided by you that we did not request, Looksee Inspections undertakes to determine within a reasonable period if we could have requested such personal information under APP 3. If Looksee Inspections determines that we could have collected the information under APP 3, we may then use and treat that information as if we had collected the information in that manner.  If we determine that we could not have collected the information under APP 3, Looksee Inspections will destroy or de-identify that information within a reasonable period.

Notification of the collection of information (APP 5)

When we collect information about you, Looksee Inspections will make it clear to you, either at or before the time, or as soon as practicable afterwards, why we are collecting such information.

How we use the information (APP 6)

We will only use personal information to respond to lawful requests, to answer your enquiry, for direct marketing purposes where your information has been provided for that specific purpose, or in relation to the engagement of services.

The information is held only for as long as it is required to fulfil the purposes for which it was collected or as required by law. Legislative requirements compel Looksee Inspections to keep information about your inspections for a period not less than 5 years.

Direct marketing (APP 7)

Looksee Inspections will only use personal information we hold for the purpose of direct marketing if you provided this information for this specific purpose.  Testimonials or social comments used in our marketing will be with your permission. The permission will form part of the engagement process and you will need to notify us to opt out.
Personal information held by Loose Inspections will not be disclosed to third parties except with your express permission (e.g. engage a consultant on your behalf).

Email and website management

Whilst Looksee Inspections takes steps to provide a secure internet environment, you should be aware that there are inherent risks associated with the transmission of information via the internet.

Email addresses are collected from customers in accordance with this policy.

Our website may contain links to third party industry or government websites.  If you access those websites you will be subject to the privacy policy of that third party.  In some cases those third party providers may not be subject to the Privacy Act. Looksee Inspections will not be taken to endorse or accept responsibility for any privacy issues arising as a consequence of accessing that web-link.

Quality of information (APP 10)

Looksee Inspections will take all steps reasonable in the circumstances to ensure that personal information we collect from you is accurate, up to date and complete.  Where we collect information directly from you, we rely on you to supply accurate information and we may not consider further steps are required.

Security of information (APP 11)

The Privacy Act 1988 has specific provisions that prohibit any employee of Looksee Inspections or their consultants from collecting, using or disclosing anyone’s personal information except in performing their duties and in specific situations permitted by law. Your personal information is disclosed in accordance with the law or with your written permission.

We take all reasonable steps to ensure the integrity and security of administrative files, physical and electronic, in our possession to protect against loss, unauthorised access, misuse, disclosure or modifications and to ensure that only authorised employees have access to such material.

Data breaches

In the event of a data breach involving personal information, Looksee Inspections is obliged to advise any individual where that breach is likely to result in serious harm.  This is known as an ‘eligible data breach’.  This notification will include recommendations about the steps that should be taken by the impacted individuals in response to this breach.

Access to personal information (APP 12)

Looksee Inspections will allow you access to any personal information we may hold on your file unless there are lawful reasons to refuse you access. Personal information can only be provided to a third party upon your written permission or if authorised by law.

In certain circumstances we may refuse access if we reasonably believe that doing so would pose a health or safety risk to any individual, have an unreasonable impact on the privacy of others, or that we consider the request to be frivolous or vexatious.  We will not release information if it relates to existing or anticipated legal proceedings between Looksee Inspections and you and it would be protected by legal professional privilege, any potential negotiations between Looksee Inspections and you would be prejudiced, or if it is illegal to release the information.

Looksee Inspections will not release information if in doing so, would reveal information that is commercially sensitive to its own business activities.

Correction of personal information (APP 13)

If you believe that personal information collected by Looksee Inspections about you is inaccurate, incomplete or not up-to-date, please contact us and we will take reasonable steps to correct it in accordance with the requirements of The Privacy Act 1988.

Refund Policy

Where a report is provided that, in a materially significant way, is not as described in our pre-engagement agreement, we will issue a refund. Our access to properties is limited by the owner or their representative and in the case of strata or company title inspections, we can only inspect those records made available to us. No refund will be made where our access to a property or to records has been limited. If we don’t send the report to the nominated email address within 72 hours (excluding weekends and public holidays) of gaining access to the property (or books and records in the case of a strata inspection) we will issue a refund.

Order Cancellation

Once a booking has been placed, and providing the inspection has not commenced, a cancellation fee of $100 inc. GST will apply. Looksee may choose under some circumstances to waive this cancellation fee.

No cancellation is possible once the inspection has reached the inspection location or if the inspection has commenced.

Credit Or Debit Card

We accept Direct Deposit, Direct Payment, and Visa & MasterCard. Surcharge apply for Visa & Mastercard transactions, these are applied upon checkout via Pin Payments (payment gateway). Please be sure to provide your exact billing address and telephone number. Incorrect information may cause a delay in processing your booking. Please note credit card transaction require you to apply your address as part of online compliance.

Security

The checkout on Looksee Inspections is secured using a 256 bit encrypted Secure Socket Layer (SSL) certificate provided by SiteGround. All payments are processed using our payment gateway (Pin Payments) and our bank (BankWest). No credit card information is stored on the Looksee Inspections web server.

Prices listed on our web site are in Australian Dollars your once engaged your invoice will disclose what is applicable or what services have included G.S.T (Australian Goods & Services Tax). The prices listed are a representation of what you would expect to pay.

In the event a product is listed at an incorrect price due to a typographical error or error or calculation error, Looksee Inspections shall have the right to refuse or cancel any bookings placed for products listed at the incorrect price. Looksee Inspections shall have the right to refuse or cancel any such bookings whether or not the order has been confirmed and payment has been made.
